BALINEWSID.COM, JAKARTA – The panel of judges at the Corruption Court (Tipikor) of the Central Jakarta District Court has rejected a preliminary objection filed by the legal team of defendant Gama Ginta in an alleged corruption case.
The ruling was delivered during a court hearing on Wednesday (June 10, 2026), presided over by Chief Judge Brelly Yuniar Dien Wardi Haskori.
Although the defense’s objection was dismissed, the legal team stated that they respected the court’s decision. According to the lawyers, the rejection of the preliminary motion was understandable given that the case is closely related to proceedings involving other defendants.
One member of the defense team expressed appreciation to the Public Prosecutors (JPU) for providing access to and allowing the defense to examine the Analysis Report (Laporan Hasil Analisis/LHA). The lawyers described the move as a positive contribution to ensuring a fair trial process.
“The court is the final pillar for those seeking justice. Transparency in legal proceedings is essential, not only for internal assessment but also as part of strengthening an accountable legal system,” a defense lawyer said after the hearing.
The lawyer emphasized that access to the Analysis Report was particularly important due to the complexity of the case. He noted that it would be impossible to thoroughly review all case files within a short period, especially considering that the investigation had been ongoing for more than a year.
The defense team further argued that a defendant’s right to fully understand the charges against them is a constitutional right guaranteed under Indonesia’s legal system. They also referred to the International Covenant on Civil and Political Rights (ICCPR), which Indonesia ratified through Law No. 12 of 2005, guaranteeing every individual’s right to adequate legal defense and equality before the law.
Looking ahead, the defense plans to present publicly available Analysis Reports as comparative evidence in future hearings. The lawyers believe the documents will help strengthen their legal arguments while ensuring that the evidentiary process remains objective and transparent.
The defense team also reiterated its support for the corruption eradication efforts carried out by the Attorney General’s Office of the Republic of Indonesia. However, they stressed that all law enforcement processes must continue to uphold the principles of justice, objectivity, and the protection of defendants’ rights.
