Bali DPRD Special Committee Demands Transparency Over 15-Hectare Land Dispute in Badung

BALINEWSID.COM, DENPASAR — The Special Committee on Spatial Planning, Assets, and Licensing (Pansus TRAP) of the Bali Provincial DPRD has renewed its scrutiny of the prolonged land certification dispute in Pecatu and Sempidi villages, Badung Regency, calling for transparency and concrete action from relevant authorities.

The issue, involving approximately 15 hectares of land in the DN 98 area, was discussed during a public hearing held on Thursday (April 9), attended by committee members, experts, the Head of the Badung Land Agency (BPN), and representatives from the Bali Provincial Financial and Asset Management Agency (BPKAD).

Chairman of Pansus TRAP, Dr (c) I Made Supartha, criticized the slow progress in resolving the case, stressing that administrative clarity should have already led to a firm decision.

“If the land is not recorded as a regional asset, it must be clearly stated. Why is this taking so long? If something is already clear, it should be resolved quickly,” Supartha said during the hearing.

He also highlighted irregularities on the ground, including land parcels that have already been certified and indications of land subdivision practices followed by sales to certain parties. According to him, such conditions could trigger new legal disputes if not addressed transparently and decisively.

Supartha urged institutions involved not to shift responsibility between one another and called for direct field verification to ensure consistency between administrative records and actual conditions.

From a legal standpoint, the committee emphasized that land disputes can be resolved through administrative mechanisms, including the annulment of land rights if administrative defects are found.

“If there are administrative flaws, the mechanism is already clear. There is no need for prolonged delays. This can be resolved,” he added.

The committee also criticized the slow response to public complaints, revealing that some reports from residents have gone unanswered for more than five months.

“Public complaints must not be ignored. They must be responded to. People should not be left in uncertainty,” Supartha stressed.

Meanwhile, Head of BPKAD Bali Province, I Ketut Maduyasa, stated that his office has been actively handling the issue but emphasized the need for caution as it involves regional assets with legal consequences.

He explained that the DN land status is currently under historical asset tracing, involving multiple institutions, including the National Land Agency (BPN).

Preliminary data shows that the total land area reaches around 15 hectares, with approximately 2.9 hectares still unrecorded administratively. Some portions of the land have already been certified, although their origins are still under investigation.

“We must proceed carefully because this involves assets. Everything has to be thoroughly traced to avoid future legal problems,” Maduyasa said.

Despite this, Pansus TRAP insisted that caution should not be used as a reason to delay resolution. The Bali DPRD affirmed it will continue to oversee the case, including evaluating parties involved in issuing land certificates in the disputed area.

The hearing underscored that the DN 98 land dispute is not merely an administrative matter but also concerns legal certainty and public trust in governance.
